I recently bought a used 330i which had about 28,000 miles on it. When i took it in for the bmw buyers check they told me to have the brake pads replaced when i bring in the car for the next service.
I have an extended warranty on the car.
My question is whether i would have to pay for the brake pads or if it is covered under the extended warranty.

Brake pads are not covered under an extended warranty....it is a wear and tear item. They would be covered, however, if you had an extended maintainance program that was purchased with the car.
Your pads have sensors in them and will tell you when it is time for a pad replace.

If the car is a '02 with 28k, the 330i should still be under the maintainance warranty.

The car was bought in Oct 2001. Does the maintenance warranty run till Oct 2005 (i am not sure if it is 3 yr/36k or 4 yr/50k on the warranty).

The car is under the manufacture warranty till Sep 05 and the service personnel told me that brake pads is a wear and tear item and is not covered under warranty.

Right, a E46 '01 maintenance warranty is for 3 years, in '02 the warranty was extended to 4 years.
