 Door ding law suit

A question for lawyers out there. The b*tch next door intentionally dinged my still new bimmer, so hard that the paint is damaged, hid her car in the underground garage and skept the town. She's been harassing me about the parking situation, leaving notes on my windshields, and this happened after I finally told her to stop harassing me.

The insurance company wouldn't cover it under my comprehensive as they consider this to be a collision, so I plan to take her to court when she returns. The damage to my passenger door matches the scrape on her driver's door edge. I will also send out the paint sample for analysis. My question is, will the damage location match, and possibly the paint match, be enough to win the case? There is no witness.

Since this appears to be more than just a simple door ding case, I'd get a lawyer and explain ALL the details, including why she is harrassing you. Without knowing the whole story, no opinion can be offered. I hope you've kept these notes too, as they're evidence.

What is the parking situation? What were you doing that made her write you letters?

From your testimony, I find for the defendant.

From his testimony, I am for him, under no circumstances should anyone damge anyone else's property.

Maybe he dinged her car? She was mad at him and attempted reasonable communication.

Obviously we know too little to make any real finding.

The story is that we have a tight two car port with poles on either side. About a foot inside line is best I can manage without hitting the pole, but she's been leaving notes telling me to scoot over more. (She has a V8 coupe with large door.) I finally got pissed and told her to stop harassing me and get a smaller car if she has so much trouble parking.
