Interesting CPO nightmare
I read this article on CPO's, very interesting, isolated case most likely, but has anyone else had similar experiences?

| | Reply » Interesting CPO nightmare | I'm not defending BMW's CPO program since I have no experience with it but this wasn't a BMW CPO. It was a car dealership that had no ties with BMW slapping a 'Certified' moniker on the car.
Only a BMW dealer can sell you a BMW CPO vehicle.
That's how I understand it anyway.

EDIT TO ADD: if you go to dealerrater.com and search for FMW you will see a post by "bailey" where she states she won her lawsuit against the dealership.

http://www.boston.com/business/artic...pre_owned_bmw/ | Still.. it wasn't a CPO BMW.. Just a shady BMW dealer selling a crappy used car, plus a 3rd party extended warranty..
I will agree.. she was deceived...
All that said, even a CPO BMW should be gone over with a fine-toothed comb for previous abuse/accidents. The program is only as good as the selling dealer.

Should a consumer have to ask the dealership to provide the CPO checklist or whatever? I guess a consumer who is suspect about the dealership should ask for this (which is a good idea) but there is a large portion of people that trust the dealership (and they should). I think the problem comes in in that there is a huge financial incentive for the dealership to lie and little threat of getting caught. What BMW needs is a person that audits the dealerships. Surprise inspections of the cars, etc. OTOH, BMW can't do a whole lot to punish dealers so it probably won't work. Illustrates why a PPI is always a good idea what purchasing a car no matter where the car comes from.
| | Reply » Interesting CPO nightmare | I don't know, I think she's the one with the problem here. Quote: Riegelhaupt was so furious that she demanded her money back, but the dealership insisted on fixing whatever was wrong, in compliance with the warranty it had sold with the car.
Riegelhaupt refused to relinquish the car without getting her money back. "I kept thinking, 'What's going to go wrong with this car next?' " she said in an interview last week.
She sued Foreign Motors West, claiming breach of contract. She had no claim to a refund under the state's used vehicle warranty law because the vehicle hadn't been repaired three times for the same defect or out of service for 11 business days. In her suit, she asked for $23,000 in actual damages and additional money for attorney's fees, costs, and violations of the state's Consumer Protection Act. | So, in short, she's an idiot. She had a warranty, but instead of letting them fix the issues she discovered, potentially allowing her to receive a refund anyway if they fail to do so properly, she decides to sue. Moron.
And the fact that the car was in an accident means nothing - if it was cosmetic damage only, and repaired properly, who cares? Quote: | Riegelhaupt took the vehicle to an independent mechanic, who verified the transmission was shot. He also discovered a rusty dust cover on a shock. | Oh, a rusty dust cover? My god, how awful.
