Well, a month to the day of having my car, I have picked up my first dent. I was in Los Angeles, stopped at a red light on a two-lane road. The right lane - which I was in - was blocked off by cones because of road works. When the light turned green, I waited for an opening to merge left - indicator on, etc. I looked in my driver's side wing mirror and saw an Audi A4 - also stationary. The driver was on the phone. I could see the entire width of the Audi in my wing mirror to give you an idea of distance. I checked my blind spot and started merging left. Because I had only just started moving and traffic ahead was still moving slowly, I was only going about 5 - 8mph when I heard the sound of an engine revving a little excessively given the circumstances. Next thing I know: contact. The driver of the other car didn't even realize until I got out of my car and pointed at the dent.

My rear left wheel arch has a dent about four inches long. My rear left wheel is scratched on about 80% of it's surface. The rear left tire has been damaged in such a way as to set off the Flat Tire Warning in the car. The preliminary estimate from Harry's on La Brea - $1157 for the body work and reconditioning the wheel; $350 for a new rear tire - all from a brush that the other driver didn't even notice.

Because of the long weekend, I won't find out who was at fault until Tuesday. Going over it in my mind, I really can't imagine what else I could have done, except waited for the driver of the other car to give me some kind of signal to move.

There is really no point to this post. I just feel really down about the car getting hit and possibly losing my "No At Fault Accidents" standing with my insurance company. Thanks for reading.

The common rule is that the person hitting from behind is almost always at fault since one has to make sure to keep proper distance and awareness of the cars around him..

In your case, its a little bit complicated than that, but I wish you good luck in convincing your insurance co. that he was not paying attention... Make sure to mention that he was on the phone.

Man, that sucks. I got my first blemish as well, though much more minor. It was very wet and this truck coming from the opposite direction forced me to move way to the right. There was a pothole full of water that I hit and it was about 1/2 ft. deep. I was going slow enough that there was no major damage, but the front right corner lip is all scraped. The roads get so bad here and with the salt in the winter, I'm starting to think it's just a bad idea to have a nice car here.

I'm really hoping that I am not found to be at fault. Again, I don't know what I could have done differently. Looking back, my feeling is that the driver of the Audi tried to force me out of making a lane change, but severely misjudged the distance and the speed required to cover it and ended up crashing into me rather than simply blocking me out.

I've had similar thoughts over the past couple of days. When something like this happens you always seem to wish that you were driving an Explorer rather than a BMW. While I was at Harry's, the auto body repair shop, I saw a couple of Bentley Continental GTs and an Aston Martin Vanquish that looked like they had been in really bad accidents, so I guess it could be worse. Being really saddened by dents, dings, and sratches is just the price we have to pay for driving cars that we love.
