 damage after dealer delivery



So I took delivery after the dealership closed at night the salesman was nice enough to deliver after hours. In a rush to make the drive home I did a quick inspection and was on my way. Got home and noticed a huge gouge (around 1.5 inch) and a smaller gouge (.25 inch) in the right lower side skirt. Now how did they miss this if they took delivery during the day and they also washed it? Are they trying to pull something at the dealership or is it an honest mistake? Is it the VPCs fault? Transport from VPC? Dealer? I know it wasnt me. Whos to blame and how do I fix? Thanks

BTW adding to this drama the dealership is 5hr drive from where I am. Im not very happy right now

That's not pleasant. I would call him right away to explain the situation. Assume they weren't trying to pull a fast one, and that they just didn't notice. Probably the cleaning guys aren't the salesman, and they likely wash cars all the time with dents--just the way it is. And the salesman didn't notice.

They're likely to say that there's no way to prove the damage didn't happen during the five hour drive home (and that's certainly possible). Dunno what your answer is to that, other than maybe they can help you out.

FWIW, someone's insurance should cover it--BMWNA's up to delivery at the dealer, the dealer's insurance from then.

I got body shop to inspect and they said no way is that road damage and looks like it was damage from slipping of a jack or something during transport. Regardless the salesman accussed me saying i did it and hit something on the road. He didnt even give me the benefit of the doubt and look into it, instead just accussed me. The only way you would see it if you inspected the vehicle from 4-5ft out or got down on your hands and knees. Question is do i have any recourse? I didnt sign a damage disclosure. Its almost more principal than anything else. I bought a 750Li and would take responsibility if i damaged the car myself. Im am furious they will not give me the benefit and do the right thing. I have the least to lose but am sure the person who did the damage would lose a significant amount from their paycheck or possibility of tarnishing their job record.

E-mail gerling and advise of the damage. They will tell you what to do.

I would also write a letter to the GM of the dealership, detailing how the salesman accused you of doing the damage (inexplicably).

By the way the spot on the door is just a smudge not damage.
