Today I was at a dealer showing my wife the car that I'm supposed to pick up on Nov 3 ED. My car is built and ready to go. However, when sitting in a nearly identical vehicle (330xi with sport, cold weather, 162 wheels) I got very rude shock -- there was no lumbar support, neither manual or electric. I have a serious chronic back problem, and not being able to adjust the lumbar is a fatal error. My mistake in ordering is a result of the mis-information I received from a dealer (although, not the guy I ordered the car from) that the 330 with SP includes power all around, including bolsters and lumbar. He was wrong, and I'm screwed. Do I have any options? Do you think BMW in Munich will swap a car for me with Premium Package -- I'd be willing to even take a different color? Do you think I have any chance of getting my dealer to take this car, and swap it for a comparable with Premium. Of course, I'm ready to pay the extra cost of PP. I should add that I'm prepare not to drive the car in Europe if the dealer is willing. I work in Paris, so, I was just going to fly up to Munich for the day anyway, and just drive it from the delivery center to the drop-off. Any advise of suggestions are welcome. One last thing I should mention. I have yet to pay for the car, other than a deposit. Does this change anything?

I think the fact that you haven't paid for the car is your saving grace. If you don't pay they can't complete the deal.

This situation will test your dealer and BMWNA for their commitment to customer assistance. If they can they should be able to pull a similar vehicle from production or from their unshipped stock and make it work. They might tell you that you need to start over from square one but hopefully they will offer a solution. They build 1000's of 3 series every week. Surely they can make things right. I feel for you....I have back problems too and the lumbar is heaven-on-earth for me.

On a related note...have you tried the Tempur Pedic mattress? I swear by mine.

You might be able to get a car out of the E.D. pool but I would imagine there would be a limited number of 3ers with Xdrive sitting around.

Timing is such that you are probably better off starting from scratch.

I agree the lumbar is very important (also have back issues) and also need the extra adjustability of the seats that come in the sports packge. I waited what was probably an extra 5 or 6 mos. for my first E46 coupe, because BMW kept delaying the sport package and hence the SP seats. I had my 2nd E36 much longer than I planned.

Yea starting over probably the best bet, since you work in Paris and don't have as much travel constraint as those of us having to cross the pond. However if you plan to re-order then you need to hustle to get a Nov. production date since there's only 1-week of production during Dec.

Maybe you should consider doing US delivery instead? Maybe your dealer can find something already produced and on the way over.

Another option to consider (it may be a long shot but if all else fails): Ask your dealer to negotiate a price on premium package seats. If they were the dealer that lead you wrong and own up to the mistake, they should give you a good price. Wiring and mechanics wise, it should be a simple swap.

Another item of last resort: A good upholstry shop should be able to integrate a lumbar adjustment into an existing seat. See if the dealer can negotiate a wholesale price for you.

Called BMW and they said that they would do nothing. They acknowledged that the car is just sitting at the factory waiting to be shipped along with 100s of others, but they were not even willing to discuss a solution. The dealer is trying to figure something out for a swap, but the outcome is uncertain.
