I had just done around 1250 miles needed for brake in. I tried to floor the gas pedal and max the car would do is around 140mph. I was hoping at least 150 mph given that odometer shows 160mph as max.

I believe that's about it. My e36 M3 had a limiter at the same MPH. The e46 M3 has an artificial limit at 155, so we can be pretty sure the 330 will be more restricted. You can keep it in 5th and probably get a bit higher speed out of it.

Sport package models of the 330i are limited to 149 mph, non-sport are limited to 130 mph, according to the BMWUSA web site.

Mine was an automatic so not sure if that makes a difference. I tried to put it in DS mode to see if that makes a difference but all the car would do is just shy of 140mph.
It would have been nice to go for a stickshift but after driving a stickshift for 7 years, dilemma of stop and go traffic and pressure from significant other took over and went for automatic.
After seeing that website, it makes sense. But I did get it beyond 130mph, but not completely 140, just little short of 140mph.

-JC. | That's probably a speedo error with acceptable range then of plus 5-8% at 130mph.
You can grab a snap shot of your speed according to the on board computer by resetting the average speed display at any given moment. It will be more accurate and probably show closer to 130mph.

Yes, these folks are right.
If you checked other E90 boards like e90post, you'd see pictures from folks with 330i sports package going well over 150 mph according to their speedometer. Again, there's that error percentage like E36M3r mentioned but that's nevertheless just a little over 10 mph faster.
