Hello all,

Here is the situation: my lease on 2002 320i is up in one week. Two weeks ago I signed a new lease for 2006 325i As an incentive, my dealer agreed to touch up a few body scratches before I give the old car back to BMW financial Yesterday I swapped the cars – left my old one at the dealer so they can take care of it before BMW takes it back. The issue is that my front brakes went about two days ago – no warning light came on but some serious steel on steel noise was coming from the passenger side. Now, after all the paper work is finalized for my new car, the dealer tells me to be prepared to pay for the brake job Is it normal for to be forced to replace brakes before returning the car at the end of the lease term, or is my dealer just trying to cover his cost of doing a touch-up work? I wonder if there is a way to negotiate with BMW, considering that I just signed for another lease. Other than minor paint damage the car is in a great shape, only 57,000 km on it after 36 months term. I was really hoping to get my security deposit back.

Any advice would be greatly appreciated.

The car has to be in regular working order and have no more than normal signs of wear (so body damage has to be repaired before return). Read the fineprint. Steel on steel brakes are certainly not normal working order, so your dealers handling is quite correct. Just imagine what would happen if those regulations were not in place. People would run down their car at the end of the lease and neglect even the most basic maintanance.
All in all, a lease is like a rent in many ways. They gave you an intact car and can expect to get it back intact. Rundown brakes are not intakt.

So regular wear (minor scratches, stone chips, signs of use on the interior) is allowed, but the car would have to be in a sound shape so the dealer can resell it without having to do any more than minor cosmetic work on it. Thatīs what the financial calculations are based on. Itīs just fair.
